Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cue Caller website and services ("Service") provided by Cue Caller ("we," "us," or "our"). By using the Service, you agree to these Terms.
1. The Service
Cue Caller provides AI-assisted call management tools for front desks, including missed call recovery, live call queue, bilingual intake, searchable call history, analytics, and SMS/MMS notifications.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information in your account and for keeping your credentials secure.
3. SMS / Text Messaging Program Terms (A2P 10DLC)
Program description
When you or your customers opt in, Cue Caller sends SMS/MMS messages related to appointment reminders, missed call follow-ups, callback confirmations, account notifications, and customer support. This is a transactional and conversational messaging program operated by Cue Caller.
How to opt in
By providing a mobile phone number through our website, demo request form, intake form, or by texting us first, and by agreeing to these Terms, you consent to receive SMS/MMS messages from Cue Caller at the number provided. Consent is not a condition of purchase.
Message frequency
Message frequency varies based on your account activity and the events that trigger messages (for example, an inbound missed call or an upcoming appointment).
Message and data rates
Message and data rates may apply. Check with your mobile carrier for details about your plan.
How to opt out
You can cancel SMS messages at any time by replying STOP to any message you receive from us. After you send STOP, we will send a confirmation message and you will not receive additional SMS messages from that program. If you want to opt back in, sign up again as you did the first time.

Supported carriers
Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, and most other U.S. carriers. Carriers are not liable for delayed or undelivered messages.

See our Privacy Policy for details on how we handle mobile opt-in data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
4. Acceptable Use
You agree not to:
- Use the Service to send unlawful, harassing, or unsolicited messages
- Send messages to recipients who have not provided proper consent
- Violate any applicable law, including TCPA, CAN-SPAM, and carrier rules
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service
- Use the Service to impersonate any person or entity
5. Fees
If your plan is paid, you agree to pay all fees described at signup. Fees are non-refundable except as required by law or expressly stated by us.
6. Intellectual Property
The Service, including its software, design, and content provided by us, is owned by Cue Caller and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that messages will always be delivered or that the Service will be uninterrupted or error-free.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CUE CALLER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
9. Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms. You may stop using the Service at any time.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Venue for any dispute will be the state or federal courts located in San Bernardino County, California.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
